The divorce needs to be formally documented before the competent court within a specific period. The UAE Personal Status Law (Federal Decree-Law No. 41 of 2024) gives clear timelines, procedural obligations, and consequences for non-compliance regarding divorce documentation. The law applies broadly to UAE Muslim citizens, non-Muslim UAE citizens (unless they have sect-specific provisions), and even to non-UAE nationals unless one party insists on applying their own law.

Obligation to Document Divorce

  1. The divorce may religiously or socially occur first, but legal documentation is still mandatory.
  2. Article 58 of the UAE Personal Status Law (Federal Decree-Law No. 41 of 2024) states that the husband has the obligation to document the divorce before the competent court within 15 days from the date of the divorce.
  3. Documentation protects both parties’ legal rights. The wife can independently file a divorce case if the husband fails to do so.

Compensation for Failure to Document

If the husband fails to document the divorce within 15 days without any court-accepted reasoning, the wife is entitled to compensation. The compensation is calculated as the equivalent of alimony from the date the divorce occurred to the date it is finally documented, meaning the longer the delay, the greater the compensation owed.

Documentation of Revocable Divorce

A revocable divorce is when the husband can take back the wife as long as she is in the waiting period. The take back is only valid if it is final and should not be suspended on a condition or added to the future. In a revocable divorce, the husband must officially document the take back within 15 days, provided the original divorce was already documented.
