In recent conflict situations, there have been multiple instances of people filming content relating to the conflicts and posting or sharing it on social media platforms. Several individuals have been penalized for such actions. In the current scenario, these acts may compromise national security, create unnecessary panic among the public, and lead to other serious consequences. Additionally, such conduct may also violate privacy rights where individuals are involved. Residents of the UAE have been warned not to circulate rumours, unverified information, or any photos or videos relating to the ongoing conflicts.
Legal Concerns
Under Federal Decree-Law No. (34) of 2021 On Countering Rumours and Cybercrimes
- Sharing videos reports or information that harms the reputation dignity or security of UAE can lead to a temporary imprisonment.
- Publishing content that mocks or damages the reputation of the UAE, its authorities, national symbols, or public figures may result in imprisonment for up to 5 years and fines of up to AED 500,000.
- Taking photos of third parties in any public or private place and keeping or sharing it without consent may lead to an imprisonment of at least 6 months and fines ranging from AED 150,000 to AED 500,000.
- Disseminating false news, misleading rumours, or reports online that may disturb public peace, spread fear, harm public interest, public order, public health, or the national economy is punishable with imprisonment for at least 1 year and a fine of not less than AED 100,000.If such acts occur during epidemics, crises, emergencies, or disasters, the punishment increases to imprisonment for at least 2 years and a fine of not less than AED 200,000.
Under Federal Law by Decree Promulgating the Crimes and Penalties Law
- Publishing information or inciting acts through communication platforms or information technology that may endanger state security or harm public order is punishable with temporary imprisonment.
Hence the law criminalises the following actions:
- Photographing or filming any content relating to the recent conflicts.
- Publishing such contents online.
- Spreading rumours and sensitive information and creating a panic amongst the people.
- Invading privacy by sharing videos or photos of any affected parties.
During times of conflict, it is important that only real and accurate information is circulated. The UAE government has been making tireless efforts to address the current situation without adversely affecting anyone and without compromising the rights of residents.
