Deportation is the legal process through which a foreign national is required to leave UAE pursuant to a judicial or administrative order.
The principal law governing deportation is Federal Decree-Law No. 29 of 2021 concerning the Entry and Residence of Foreigners, its implementing regulations, and Federal Decree-Law No. 31 of 2021 concerning Crimes and Penalties, as amended.
UAE law recognises two main forms of deportation: judicial deportation and administrative deportation.
Judicial Deportation: When a Court Orders Removal
Judicial deportation arises from criminal proceedings. Under Article 126 of the UAE Crimes and Penalties Law, deportation is generally mandatory when a foreign national receives a custodial sentence for a felony, subject to applicable statutory exceptions.
In misdemeanour cases, the court may have discretion to order deportation, depending on the offence and relevant legal provisions. Certain offences, including drug-related crimes, are also governed by specific deportation requirements.
Importantly, a person facing judicial deportation may challenge the criminal judgment through the appeal procedures.
Administrative Deportation: Even Without a Criminal Conviction
Unlike judicial deportation, administrative deportation does not necessarily require a criminal conviction.
Under the UAE Entry and Residence Law, competent authorities may order the deportation of a foreign national on grounds relating to public interest, public security, public morals or the absence of an apparent means of livelihood.
An individual may therefore face administrative deportation even while holding a valid residence visa.
Such decisions can have serious consequences, particularly for individuals who have established long-term employment, businesses or families in UAE.
Can a Deportation Order Be Challenged or Cancelled?
UAE law provides legal avenues to challenge deportation, although the procedure depends on the nature of the order.
Judicial deportation may be challenged through criminal appeals or other remedies permitted by law. Administrative deportation may be reconsidered through an application to the competent immigration authority, supported by relevant documents and legal grounds.
Family circumstances, employment history, financial responsibilities and humanitarian considerations may be relevant, depending on the case.
However, cancellation is not automatic, and every application must be assessed on its individual merits.
Dubai’s 2025 Resolution: An Important Legal Development
An important development is Dubai Resolution No. 1 of 2025, concerning the Tribunal for Review of the Enforcement of Deportation Judgments and Travel Ban Orders.
The Tribunal has authority to examine cases where a person faces both deportation and a judicial travel ban. It may suspend deportation enforcement, cancel the travel ban or grant temporary release subject to appropriate guarantees.
This provides an important mechanism for addressing conflicting enforcement orders, although it is not a general appeal forum for every deportation decision.
Can a Deported Person Return to UAE?
Deportation generally prevents a foreign national from returning to UAE without obtaining the necessary special permission.
There is no universal deportation-ban period applicable to every case. The possibility of re-entry depends on the legal grounds for deportation, the applicable restrictions and approval from the competent authorities.
Conclusion
Deportation in UAE is not merely an immigration issue. It can affect a person’s family, employment, financial commitments and future opportunities.
While UAE law empowers the authorities to protect public security and enforce immigration regulations, it also provides procedures through which affected individuals may seek legal remedies.
Early legal intervention, proper documentation and an understanding of the applicable laws can make a significant difference in protecting an individual’s rights and exploring the possibility of challenging a deportation order.
